TRANSLATION FROM POLISH
Extract from the Land Registry Books of the
Nowogrodzkie Province.
In the year one thousand seven hundred sixty
five, on the fifteenth day of January.
Before us, Ignacy Wajnilowicz, Jan Rowuski
[?], Michal Krzysztowski, Felicjan Danieyko,
the Judges, and Kazimierz Ignacy Korsak,
the Scribe, Land Officers of the Nowogrodzkie
Province at the Land Court of the Nowogrodzkie
Province, during the Epiphany assizes, Comparendo Personaliter the honorable Jozeff Tumilowicz related
and presented his perpetual testament of
relinquishment with the matter contained
therein that was issued to his sons: Andrzej,
Bazyli, Jan, Leon, and Dementian Tumilowiczes,
and by his own... acknowledgement and stated
[that] he requested of us, the Court, that
the said testament be accepted and recorded
in the books of the Land Registry Books of
the Nowogrodzkie Province. Therefore, having
read it, we, the said Court have allowed
the record to be entered in the books de verbo ad verbum whose thenor sequitur is as follows:
I, Jozeff Tumilowicz, identified below by
signature, am making it known and confess
through this perpetual testament of relinquishment
of mine to those who need to know that having
a house of my own in the city of Nowogrodek
located at the Zarnkowa Street that was built
for my own money ... from His Lordship Lukomski
which has remained in my own possession for
over ten [?] years, today being motivated
by fatherly love and devotion, I decided
of my own free will to relinquish the entirety
of the said house to my beloved sons, i.e.
Andrzej, Bazyli, Jan, Leon, and Domentian
... the above named sons of mine ... exactly
on the date of preparation of this testament
will have the right to assume possession
of the said house and whether they wish [?]
to give, bequeath or pledge it as collateral,
they are free to do that without any impediment
from me or anyone, and should any of ...
my sons ex rel [?] that ... of my testament,
I will be obligated to defend them everywhere
on my account ... with regard to my property
and my reputation. Therefore, being advanced
in years and frequently troubled by ill health
... my estate, Losznica, located in the Minsk
Province when I myself am unable to ...;
therefore until Lord is willing to prolong
... meanwhile I assign [?] the management
of this ... to my, younger [youngest ?] son
Dementian on condition to report to me ...
accounting of all income ... when the estate
for equal distribution ... will leave ....
all the said sons. In witness of this entire
perpetual testament of relinquishment of
mine. I confirm it with my own hand. Given
in the year of the Lord one thousand seven
hundred sixty five, on this twelfth day of
the month of January.
The original bears signatures of the principals
and the sealers, as follows: Jozeff Tumilowicz;
I, Jan Bylina, was verbally and distinctly
invited as sealer of this testament ... by
Mr. Jozeff Tumilowicz and I have personally
signed and witnessed the issuance of this
perpetual testament.
