TRANSLATION FROM POLISH

Extract from the Real Estate Registry of the Minsk Province.

In the year one thousand seven hundred eighty three, the fourth day of the month of February.

Personally appearing before the Real Estate Registry of the Minsk Province, the honorable Teodor Tumilowicz presented for the records the extract of the Privilege benefiting him whose wording is as follows:

Extract from the Books of Perpetual Matters of the Office of the Castle and Province of Sluck, in the year one thousand seven hundred and twelve on the twenty third day of the month of May, at the office of the Castle of the Sluck Province, before us, Mikolaj of Rotajca [?], the Krakow Cup Bearer ... Second Starost, Zygmunt Mninski [?], the scribe at the court's location, Comparendo Personaliter, the honorable Teodor Tumilowicz, General of His Majesty, presented ad acta the Privilege granted by His Majesty King Wladyslaw III to the honorable Marcin Tumilowicz .. and the matter expressed therein that now belongs to and is of benefit [to him ?]. The honorable Jozeff Tumilowicz petitioned this office that the [document] be re-written from Russian into Polish, and so it is as follows de verba ad verbun:

We, Wladyslaw III, by Lord's grace the King of Poland, the Grand Duke of Lithuania, Russia., Prussia, Zamojszczyzna, Mazovia, Livonia, Kiev, and other Lands, are announcing through this Letter of Privilege that the nobleman Marcin Tumilowicz ... bowed humbly before us ... our advice ... and entreated us, the Landlord, for the land called Skorodno located in the Czernihow Province ... twenty, we the Grand Landlord ... to us and the Republic ... our advice ... are granting this land to the nobleman Lieutenant Marcin Tomilowicz, his wife [?] and children, and his descendants for all time ... benefits ... to be binding and in force and will be ... given to him our letter ... Given in Krakow in the year from the birth of Our Lord one thousand four hundred twenty three [?] ... on the fifteenth day of the month of June ... of the Privilege and by the seal signature of the hand of His Majesty the King and the honorable gentlemen, the Deputy Chancellor of the Treasury and the Scribe of the Grand Duchy of Lithuania in these words: Wladyslaw Steffan, the Deputy Chancellor of the Treasury of the Grand Dutchy of Lithuania, Leon Sapieha, the Scribe of the Grand Duchy of Lithuania.

This Document, as presented by the above named person, has been accepted and recorded in the Books of the Perpetual Matters of the ... Principality [?], the extract of which is being issued under the official seal of the Minsk [?] Castle ... to the honorable Jozef Tomilowicz; Scribe ut supra [?]; at ... this Privilege Extract ... the Seal of the.... NOTES on NARB, F319, Op2, Nr3293, K12-13

This document of February 4, 1783 is an extract from the registers of Perpetual Legal Matters in the Principality of Sluck presented by Teodor Tumilowicz to the Real Estate Registry of Minsk Province. Originally, it was recorded at the Castle of Sluck, when it was translated from Belorussian to Polish, at the request of Jozef Tumilowicz on May 23, 1712. The document describes a grant of land (600 acres) called Skorodno in Czernihowski Province conveyed to Lieutenant Marcin Tumilowicz by a Polish king in 1423. Skorodno lies about 20 km northwest of Swierynowo (See map.). Sluck, a large city located due south of Minsk, also can be seen on the map.

Dr. Dumin has identified historical inconsistencies regarding the dates and identity of the king and has suggested that mistakes in copying might have occurred because of the presumably already very old and perhaps poorly preserved document upon entry into the record at the Castle of Sluck in 1712. It was King Wladyslaw IV (1632-1648) not King Wladyslaw III (1434-1444) who made grants of land in Czernihowski Province. Such privileges were granted in this province around 1630-1640 rather than in 1423. Furthermore, assuming a reasonable range of birthdates for each of the descendants of Marcin T. to Dementi T., whose birthdate (1731) is known, and based on the last testament (1580) of Gregorz T.*, grandson of Marcin T., the grant of Skorodno could not have been made in 1423. The same assumptions also suggest that the grant could not have been made between 1630-1640 but more likely around 1500, i.e., during the reign of King Kazimierz Jagiellonczyk (1444-1492) or King Zygmunt I (1506-1548). Consistent with a date around 1500 (possibly 1523 rather than 1423) was the rendering of the apparently original document in Belorussian, which was the language of the courts and upper classes in the Grand Duchy of Lithuania at that time.

Nevertheless, despite historical inconsistencies in this document, the testament of Gregorz Stanislawow T. (See NARB, F319, Op2, Nr3293, K1-6.) dated March 5, 1580 and confirmed November 26(?), 1643 at the Main Tribunal of the Grand Duchy of Lithuania, supports ownership of Skorodno by Marcin Tumilowicz. The testament of Gregorz T. stated that he bequeathed to his sons, Jan and Tomasz, funds received from the sale of Skorodno, granted to his grandfather, Marcin T., for military merits.

*Gregorz Tumilowicz was the great (7) grandfather of Antoni J. Tumilowicz.
